The firm’s initial work for its clients often involves litigating complex business disputes that the client has never confronted, let alone planned for. Yamin & Grant actively represents clients in litigation involving construction disputes, commercial transactions, insurance coverage, business torts, fiduciary duties, shareholder disputes, contractual disputes and employment related matters. Its lawyers regularly appear in state and federal courts throughout Connecticut and have appeared and litigated cases in other parts of the country in association with lawyers from those jurisdictions, when necessary, to meet client needs. It is not unusual for Yamin & Grant to be asked to service all of a client’s regular legal needs, as well as assist in the development of broader strategies to avoid costly disputes and best position a client for future success should an inevitable legal dispute arise. The firm regularly advises its clients regarding the formation of business organizations, issues of corporate governance, the structuring of purchase and sale transactions and commercial leasing and property transactions. This work also involves close interactions with accounting, banking and real estate professionals, as well as other attorneys and experts in many fields.

Construction

The firm represents owners, contractors and sub-contractors involved in private and public construction projects. Yamin & Grant provides advice from the bidding process through completion of a construction project. During the bidding and contracting stages of a project, we work to identify risks that may arise and determine how to best remove the risk or address it through pricing or other appropriate contract provisions. The firm also aggressively advocates for its clients when disputes arise. The firm has broad experience litigating construction claims resulting from delays, acceleration, changes and differing site conditions and deficiencies in design or construction. The firm regularly prosecutes and defends mechanic’s lien and payment-performance bond actions.

Commercial Litigation

Yamin & Grant’s commercial litigation practice includes a diverse mix of complex commercial matters. We represent clients in all phases of litigation - from evaluating the initial decision of how to bring or respond to a claim, through trial before a judge or jury, post-trial appellate practice, and collection. We advise clients on all aspects of litigation strategy, not only with respect to issues such as choice of forum, jurisdiction, and other procedural matters, but also on cost-effective ways to achieve a business objective that can be accomplished only through litigation. We view litigation as a means to an end, rather than an end in itself. Our attorneys regularly appear in courtrooms throughout the state as well as federal courts in the United States District Court for the District of Connecticut, as well as the Southern and Eastern Districts of New York when our client’s claims arise in those districts. Yamin & Grant also regularly represents clients in a variety of alternate dispute resolution settings, including formal settlement negotiations, mediation, and arbitration before the American Arbitration Association, the National Association of Securities Dealers and the New York Stock Exchange.

Insurance Coverage

The firm’s practice representing insureds in claims against their various insurance carriers is expanding. We regularly provide policyholders advice and counsel with respect to their rights under their various policies of insurance, including coverage for construction claims and employment claims, as well as directors and officers, errors and omissions, general liability, real estate and title matters. With significant experience in the interpretation of insurance agreements and litigation of coverage issues. We can greatly improve our client’s chances of recovery. The firm’s lawyers have also represented insurers in the past which provides an advantageous perspective in working with insureds.

The firm has experience evaluating policies and providing opinions as to the extent of coverage and analyzing coverage denials and reservations of rights letters.

Commercial Real Estate

The firm’s commercial real estate practice includes significant real estate and land use matters. The firm regularly represents it clients in the purchase and financing of commercial and industrial property, office, retail and industrial leasing for landlords and tenants and various real estate development projects. Planning, zoning, wetlands regulation, environmental issues, traffic planning and other land use issues regularly arise in the matters in which the firm is involved.

Employment

Questions concerning employment agreements, including non-competition, confidentiality and other restrictive covenants regularly confront business owners and human resource managers. Yamin & Grant provides advice and services in connection with employment law issues. While regularly representing employers, we also routinely counsel officers, directors and other high level employees when the need arises. Our services include:

  • Providing advice on hiring, contracting, disciplinary actions, and discharge.

  • Litigating employment contract disputes and employment tort claims before state and federal courts and arbitration panels including covenants not to compete and confidentiality agreements.
